1. Parties & Acceptance
These Terms of Use (“Terms”) govern access to and use of the Aventus creator portal, associated upload tools, and related features (the “Service”). By creating an account or using the Service, you accept these Terms.
2. Service Description
- Creators can log in and upload batches of images (typically 5–10 at once) and single video files.
- Uploads are routed to Aventus’ Google Workspace Shared Drive structure. Aventus does not permanently store files on its own web servers.
- Files are automatically and permanently deleted after five (5) days from the Shared Drive unless deleted earlier by you. A manual “Delete now” option may be available.
- The Service is provided free of charge. No fees are payable to you by Aventus for use of the Service.
3. Accounts & Eligibility
- You must be at least 18 years old and legally able to enter a binding contract in your jurisdiction.
- Keep your login credentials secure; you’re responsible for all activity under your account.
- Aventus may refuse, suspend, or terminate access where required by law, policy violations, or misuse.
4. Content & Ownership
- You retain ownership of your content. You grant Aventus a limited, non-exclusive licence to store, transmit, process, and display content solely to operate and secure the Service and to perform deletion routines.
- You are solely responsible for the content you upload, including ensuring it is lawful and that you have all necessary rights and consents.
5. Storage, Retention & Deletion
- Uploads are stored in a per-creator folder in Aventus’ Google Workspace Shared Drive. Aventus implements automated deletion to permanently remove files after 5 days.
- Deletion is irreversible. Aventus does not guarantee recovery of deleted files.
- Backups: Aventus does not maintain separate archival backups of user uploads outside Google Workspace; if a third-party provider retains transient backups, deletion will occur according to that provider’s retention cycles.
6. Prohibited Use
You may not upload or use the Service to distribute content that is illegal, infringing, harmful, or otherwise objectionable, including without limitation:
- Unlawful content; non-consensual imagery; child sexual abuse material or any exploitative content; human trafficking or modern slavery.
- Content that violates intellectual property, privacy, or publicity rights.
- Malware, spyware, or any code intended to disrupt or damage systems.
- Harassment, hate speech, threats, or incitement of violence.
- Attempts to bypass security, probe infrastructure, or overload the Service.
7. Privacy
Personal data is handled as described in Aventus’ Privacy Policy. Core operational data includes account identifiers, upload events/metadata, folder IDs, and deletion logs. For more information or to exercise data rights, contact info@aventusconsulting.co.uk.
8. Availability & Changes
- The Service may change, be suspended, or discontinued in whole or in part at any time.
- Aventus may update these Terms for operational, legal, or security reasons. Material changes will be notified via reasonable means. Continued use after changes indicates acceptance.
9. Warranties
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Aventus disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
10. Liability
To the fullest extent permitted by law, Aventus’ total aggregate liability arising out of or in connection with the Service is limited to £100. Aventus does not exclude liability for death or personal injury caused by its negligence, fraud, or any liability that cannot legally be limited or excluded.
11. Indemnity
You agree to indemnify Aventus against claims arising from your unlawful or infringing content or your breach of these Terms.
12. Termination
You may stop using the Service at any time. Aventus may suspend or terminate your access immediately for policy or legal violations. Upon termination, your account access will cease and deletion routines will continue to apply to any remaining content.
13. Consumer Rights
If you are a consumer in the UK or EU, nothing in these Terms limits mandatory consumer rights. Where local consumer law provides additional protections, those protections prevail to the extent of any conflict.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that consumers resident in the EU/UK may bring claims in their home courts where required by mandatory law.
