1. Parties & Acceptance
These Terms of Use (“Terms”) govern your access to and use of the Aventus creator portal, upload tools, and related features (the “Service”). By creating an account, clicking “I agree”, or using the Service, you accept these Terms.
2. Eligibility & Accounts
- You must be at least 18 years old and legally able to enter a binding contract in your jurisdiction.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- We may refuse, suspend, or terminate accounts for policy or legal reasons, misuse, or security risk.
3. The Service
- Upload batches of images (typically 5–10 per batch) and single video files from phone or desktop.
- Files are routed to a per-creator folder within Aventus’ Google Workspace Shared Drive.
- Aventus does not permanently store files on its own web servers.
- Files are automatically and irreversibly deleted 5 days after upload (hard delete), unless you delete earlier using “Delete now”.
- The Service is provided free of charge. No fees will be paid to you by Aventus for uploads or use of the Service.
4. Content Ownership & Licence
- You retain ownership of your content.
- You grant Aventus a limited, non-exclusive, worldwide licence to store, process, transmit, and display content solely to operate, secure, and provide the Service (including automated deletion routines) and to comply with law.
- You represent that you have all rights and consents required for the content you upload.
5. Prohibited Content & Conduct
You may not upload, share, or use the Service for content or activity that is illegal, harmful, or violates rights, including:
- Child sexual abuse material, exploitation, trafficking, or non-consensual imagery.
- Content infringing copyright, trade mark, privacy, or publicity rights.
- Harassment, hate speech, threats, or incitement of violence.
- Malware, spyware, or code designed to disrupt systems, steal data, or gain unauthorised access.
- Attempts to bypass security, probe infrastructure, interfere with networks, or overload the Service.
6. Storage, Retention & Deletion
- Files are stored within Aventus’ Google Workspace Shared Drive in a per-creator folder created at or after sign-up.
- Files are hard-deleted after 5 days. Deletion is permanent and recovery is not guaranteed.
- Aventus does not intentionally maintain separate archival backups of user uploads outside Google Workspace; if the provider maintains transient backups, deletion follows the provider’s retention cycles.
- We may retain limited metadata (e.g., timestamps, file names, folder IDs) for audit, security, and service operation.
7. Availability & Changes
- The Service may change, be suspended, or discontinued at any time.
- We may update these Terms for operational, legal, or security reasons. Material changes will be notified via reasonable means. Continued use after changes indicates acceptance.
8. Privacy
We process personal data as described in the Aventus Privacy Policy (UK/EU GDPR compliant). Core operational data may include account identifiers, email, per-creator folder ID, upload/deletion events, and device information. For questions or to exercise data rights, contact info@aventusconsulting.co.uk.
9. Third-Party Services
The Service relies on third-party providers, including Google Workspace. Their terms and privacy practices apply to their services. Aventus is not responsible for third-party outages or acts beyond its reasonable control.
10. Warranties
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Aventus disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
11. Liability
To the fullest extent permitted by law, Aventus’ total aggregate liability arising out of or in connection with the Service is limited to £100. This does not limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited or excluded.
12. Indemnity
You agree to indemnify Aventus against claims and costs arising from (a) your unlawful or infringing content, or (b) your breach of these Terms.
13. Suspension & Termination
We may suspend or terminate your access immediately for policy violations, legal requirements, or security risks. You may stop using the Service at any time. Standard deletion rules continue to apply to remaining content.
14. Consumer Rights
If you are a consumer in the UK or EU, nothing in these Terms limits your mandatory consumer rights. Where local consumer law provides additional protections, those protections prevail to the extent of any conflict.
15. IP Notices (Takedown)
If you believe content accessible via the Service infringes your rights, send a detailed notice to info@aventusconsutling.co.uk including: identification of the work, the infringing material/location, your contact details, a good-faith statement, and a statement you are authorised to act. We may request further information and will act in accordance with applicable law.
16. Security
We implement reasonable technical and organisational measures appropriate to the risk. No system is perfectly secure; you should keep your own backups and avoid uploading sensitive data unless necessary.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers resident in the EU/UK may bring claims in their home courts where mandatory law requires.
